How travelers can enter the U.S. on VWP?

Visa Waiver Program

For a certain national to enter the U.S. soil from a participating country, they must have the following:

  • A valid passport issued by the participating country and a citizen to that country (not merely a resident). The United States port, however, now requires a machine readable passport to be presented upon entry to avoid frauds and other matters. This was issued for permanent effect on October 1, 2007;

A machine-readable passport contains valuable biographical data provided on the data page in compliance with the standards being set by the International Civil Aviation Organization, or ICAO, Doc 9303, Part 1 Machine Readable Passports. The standards being set declares issues like the standard size of the passport and the picture, the arrangement of the entered data fields, and also the two lines printed of machine-readable data that appears at the bottom of the passport’s page. These machine readable passports can be recognized by scanning these two lines of printed data that consists of certain codes through the use of special readers.

Be seeking entry for 90 days or less as a momentary visitor;

  • For those travelers who transit by air or sea, travelers should present a round-trip transportation ticket issued by a VWP approved carrier (almost any major airlines you can find or cruise ship establishments are currently VWP approved carriers). Once issued, they should be onboard of these participating carriers upon their arrival in the United States.

A visitor or traveler should provide sufficient evidence of financial security for the expenses of his visit in the United States. Additionally, the visitor should also have a completed and signed visa waiver arrival/departure application form, or known as I-94W, on which the visitor has waived the right for any legal rights or hearing when it comes to the matter of exclusion or deportation. These visa waiver arrival/departure application forms are available for those participating carriers, from the travel agents and at those land-border ports-of-entry locations.

Note: Travelers should see to it that the carrier is indeed one of the participating establishments for the Visa Waiver Program. To do this, they should consult that certain carrier if they are one of the approved organizations of the VWP before making further travel arrangements.

Additionally, entry at a land border cross point from countries Canada or Mexico is allowed under the Visa Waiver Program. Travelers who apply for entry at these land borders crossing point are not required to provide round-trip transportation tickets or aboard a carrier that has approved by the VWP status. All other VWP requirements apply to such visitors or travelers.

How long can travelers stay in the U.S. on the VWP?

Visitors or travelers may only stay in the United States for 90 days or 3 months. There will no extensions to be honored and VWP travelers or visitors cannot change their status. In accordance to the regulations pertaining to the filled up B1/B2 temporary visitor visas, visitors under the VWP are not permitted to work or study in U.S. soil.
